Authority for Internment or cremation, Agent for Disbursements and agreement as to payment - simply Cremations TGA LTD (Simply funerals, Simplicity Holdings & Simply Cremations offices
Simply Cremations TGA Ltd requires written confirmation that the deceased family has authorised us to take care of the funeral arrangements. This form includes the Authority for interment or cremation, agent for disbursements, and agreement as to payment of the funeral account. AUTHORITY DECLARATION
1. I/WE acting as Executor / Administrator/Family Representative hereby:
(a) AUTHORISE Simply Cremations TGA Ltd ("SCTGA Ltd") to perform any hygienic preparation and sanitary preservation required for the dignified and safe preparation of the Deceased and thereafter cremate / inter the remains of the Deceased.
(b) DECLARE THAT I am/we are duly authorised by the Estate of the Deceased to give this Authority and indemnify SCTGA Ltd against any and all claims, costs and/or proceedings arising from any services and/or attendance authorised by myself/either of us.
(c) SPECIFICALLY RECOGNISE SCTGA Ltd as Principal with respect to all funeral merchandise and/or services I/we request SCTGA Ltd to provide in the normal course of SCTGA Ltd business and appoint SCTGA Ltd as my/our Agent in attending to the supply of such disbursements/items as may be requested by me/us or which are implicit in my/our instructions.
(d) AUTHORISE SCTGA Ltd to meet on my/our behalf any and all necessary debts and disbursements (as Agent) in respect of the funeral of the Deceased and to recover from the Estate of the Deceased such outgoings together with SCTGA Ltd account.
(e) AGREE to pay SCTGA Ltd account in full by the due date.
(f) ACKNOWLEDGE that any ESTIMATE provided for Burial/Cremation Arrangements is not a quote, and final costs may/shall be subject to change. SCTGA Ltd may alter the services provided based on the verbal or written request or confirmation of me/us or such other person as SCTGA Ltd believes appropriate, and any additional costs associated with such services provided shall be included in the fee charged.
2. DEFAULT IN PAYMENT OF INVOICE / CONSEQUENCES OF DEFAULT
2.1 I/WE AGREE that in the event that I/we do not attend to payment of SCTGA Ltd invoice in full by the due date, an additional late payment penalty of 10% shall be charged on the amount outstanding and interest at a rate of 2.5% per month shall be charged on any outstanding amounts and shall continue to accrue until payment is received in full. Interest at 2.5% per month shall continue to accrue after any judgment is entered.
2.2 I/WE AGREE that if I/we are in default in payment of any invoiced amount when due, I/we will INDEMNIFY SCTGA Ltd from and against all and any costs, expenses, and disbursements incurred by SCTGA Ltd in relation to collection of the overdue amounts including, but not limited to, debt collection agency fees and/or legal fees incurred on a solicitor and own client basis.
2.3 PRIVACY ACT 2020 I/we authorise any person or company to provide SCTGA Ltd with such information as SCTGA Ltd may require in response to SCTGA Ltd credit and/or employment enquiries. I/we authorise you to furnish to any third party, including those receiving assigned rights, if any, details that I/we may have with SCTGA Ltd as a result of this Authority being actioned.
3. COLLECTION OF ASHES
I confirm I will be the person collecting the ashes. If not, I will advise SCTGA Ltd in writing, who will collect them on my behalf.
4. PERSONAL GUARANTEE
I/WE ACKNOWLEDGE that notwithstanding SCTGA Ltd's entitlement to recover its invoice from the Estate of the Deceased, that I/we are PERSONALLY ACCEPTING RESPONSIBILITY for payment of SCTGA Ltd invoice and all other charges contemplated by this Authority by the due date, and not merely as a surety.
